Rental Agreement

This Rental Agreement applies to a single tool rental between an Owner and a Renter on Presta. The Renter agrees to it when booking (before any charge) and again in person at pickup. Presta Technologies LLC facilitates the rental but is not a party to it.
1. About this Agreement
This Rental Agreement (the "Agreement") governs the rental of a tool or piece of equipment (the "Item") by one user of Presta (the "Renter") from another user (the "Owner"). It applies to the specific booking the Renter is making.
Presta Technologies LLC ("Presta") operates the trypresta.com platform and facilitates the booking, payment, and in-person handoff. Presta is NOT a party to this Agreement and does not own, store, inspect, deliver, maintain, or guarantee any Item. The rental is solely between the Owner and the Renter. This Agreement supplements Presta's Terms of Service, which also apply.
2. The Rental
The Renter agrees to rent the Item from the Owner for the rental period, rate, and security deposit shown at the time of booking. The rental period begins when both the Owner and the Renter confirm the in-person pickup handoff, and ends when both confirm the return handoff (or at the scheduled end time the parties complete).
Rentals are short-term. A single booking may run up to 6 consecutive days; for a longer rental, book again when the first one ends.
3. Payment, Service Fee, and Security Deposit
- When the Renter books, the payment processor places an authorization hold on the Renter's card for the rental rate plus a Presta service fee. Nothing is charged at this point.
- That hold is captured (charged) only when the Owner approves the request. If the Owner declines, or does not respond within 24 hours, the hold is released and the Renter is not charged.
- The security deposit is a separate refundable amount set by the Owner. It is NOT charged at booking. Instead, a hold for the deposit is placed on the Renter's card at the in-person pickup and released after a clean return is confirmed — the Renter is only ever charged the deposit if damage is reported. The timing of a release depends on the Renter's bank.
- The Presta service fee is non-refundable once the rental has started.
- The Owner may offer optional paid add-ons (consumable materials such as fuel or parts, or one-time services such as delivery or cleaning). Any add-ons the Renter selects are added to the subtotal and follow the same fee and cancellation rules as the rental. Add-ons are not returnable items, carry no deposit, and are not inspected or documented at handoff.
4. Pickup and Condition Documentation
The Owner and Renter meet in person at the agreed time and place. The Owner starts the handoff and presents a QR code (or a 6-digit code).
The Renter scans or enters the code, photographs the Item's condition (timestamped and tamper-evidenced), rates its condition, and accepts this Agreement. Both parties confirm, and the rental period begins.
By confirming, the Renter accepts the Item in the condition documented in those photos.
5. Renter's Responsibilities
As the Renter, you agree to:
- Use the Item only for its intended purpose, in a safe, careful, and lawful manner, following the manufacturer's guidelines and any instructions from the Owner.
- Have the skill, training, and physical ability to operate the Item safely, and use appropriate protective equipment.
- Not lend, sublet, sell, or transfer the Item to anyone else, and keep it secure against theft or loss.
- Return the Item on time and in the same condition you received it, ordinary wear and tear excepted.
- Promptly notify the Owner of any malfunction, damage, loss, theft, or accident involving the Item.
6. Prohibited Uses and Renter Conduct
While the Item is in the Renter's possession, the Renter agrees that they will NOT:
- Use the Item for any illegal purpose, or in violation of any law, ordinance, or regulation.
- Operate the Item while impaired by alcohol, drugs, or any substance that affects the Renter's ability to operate it safely.
- Use the Item in a negligent, reckless, abusive, or careless manner, or for any purpose it was not designed for.
- Continue using the Item if it becomes unsafe, damaged, or in a state of disrepair; the Renter will stop immediately and notify the Owner.
- Lend, sublet, rent, sell, pledge, or transfer the Item or this Agreement to anyone else, or allow anyone the Renter has not been authorized to let operate it.
- Alter, modify, repair, repaint, or disassemble the Item, or remove or cover any serial number, label, decal, or safety or operating instruction, without the Owner's written permission.
- Permit any lien, charge, or claim to attach to the Item, or aid in its theft, concealment, or vandalism.
- Book or use the Item based on false, misleading, or incomplete information.
- Remove the Item from the general service area, or take it outside the United States.
A breach of this section is a material breach of this Agreement and may make the Renter responsible for resulting loss or damage as described in Section 9 (Damage, Loss, and Disputes).
7. Owner's Responsibilities
As the Owner, you agree to:
- Provide the Item as described in your listing and in safe, working condition at pickup.
- Approve or decline the request within 24 hours.
- Inspect the Item with the Renter at pickup and at return, and document its condition through the handoff process.
8. Return and Inspection
At the end of the rental period the parties meet again. The Renter starts the return handoff and the Owner inspects the Item.
If the Item is returned in acceptable condition (ordinary wear and tear excepted), the Owner accepts the return and the security deposit is released to the Renter.
9. Damage, Loss, and Disputes
If the Item is damaged, lost, or returned in materially worse condition than at pickup (beyond ordinary wear and tear), the Owner may report damage instead of accepting the return and file a claim up to the amount of the security deposit. The deposit hold is then captured to secure the funds and a dispute is opened.
Presta reviews the timestamped condition photos and the handoff timeline and decides how to allocate the captured deposit between the parties. The parties agree that this review is based on the recorded evidence and resolves the deposit allocation only.
Damage or loss beyond the amount of the security deposit is the Renter's responsibility and is resolved directly between the Owner and the Renter. Presta does not provide insurance or any coverage above the security deposit.
10. Late Return
If the Renter does not return the Item by the scheduled end time, the Renter is charged a late fee of one day's rental at the listed daily rate for each commenced day the Item is late, and may be responsible for additional losses the Owner incurs as a result. Any extension must be arranged with the Owner in advance.
11. Cancellation
If the Renter cancels before the Owner approves the request, the authorization hold is released and nothing is charged. If the Renter cancels after approval but before the pickup handoff, refunds follow the cancellation rules in Presta's Terms of Service (generally: a full refund of the rental and service fee if cancelled more than 24 hours before pickup; if cancelled within 24 hours, the rental and service fee are non-refundable). The deposit is never involved in a cancellation, because its hold is not placed until pickup. Once the rental has started (pickup confirmed), it cannot be cancelled.
12. Assumption of Risk; "As-Is" Rental
Tools and equipment can be dangerous. The Renter voluntarily assumes all risks associated with taking possession of and operating the Item, including the risk of injury, death, or property damage.
The Item is rented "as is," in the condition documented at pickup. The Owner makes no warranties of merchantability, fitness for a particular purpose, or safety beyond that documented condition.
13. Limitation of Liability; Presta's Role
Presta is not a party to this Agreement. Presta does not own, inspect, maintain, deliver, or operate any Item and makes no representation about any Item's condition, safety, or fitness.
To the maximum extent permitted by law, Presta is not liable for any injury, death, loss, or damage to persons or property arising out of or related to any Item or rental. The Renter's and Owner's remedies regarding the Item are between each other.
The Renter is solely responsible for any injury, loss, or damage to any person or property arising from the Renter's possession or use of the Item.
14. Indemnification
The Renter agrees to indemnify, defend, and hold harmless the Owner and Presta (and Presta's officers, employees, and agents) from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from the Renter's possession or use of the Item or breach of this Agreement.
15. Governing Law
This Agreement is governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules.
16. Acceptance
The Renter accepts this Agreement twice: once by checking the box when booking (before any charge), and again in person at pickup (recorded alongside the condition photos). Each acceptance is timestamped and bound to the version of this Agreement in effect at that time.
By accepting, the Renter confirms they have read, understood, and agree to be bound by this Rental Agreement.
